HAWKINSNOTICE OF INTENDEDACQUISITION OF REALESTATE BY CONDEMNATION Please be advised that the City of Bolivar, Missouri has declared their intention to acquire your interest as the heirs of Ronald C. Hawkins in the following real estate located in the City of Bolivar, Polk County, Missouri, and described as follows, to-wit: Lot 2 in Block 6 of Clark's Addition to the City of Bolivar, Missouri, EXCEPT the following: The West 65 feet of Lot 2, and a strip 12 feet wide off the North side of the remainder of said Lot 2, in Block 6 of Clark's Addition to the City of Bolivar, Polk County, Missouri. Subject to easements, reservations, restrictions and conditions of record, if any. Commonly Located At: 427 S. Clark Street, Bolivar, MO 65613 The Property is Subject to a Contract for Deed with Gypsy Rock, Inc. dated July 15, 2008 and filed with the Polk County, Missouri Recorder's Office on June 1, 2011 at Book 785 and Page 773. The City of Bolivar intends to acquire your entire interest in the real property identified above, up to and including a fee simple estate, through the condemnation procedures as set forth in Chapter 523 of the Missouri Revised Statutes and in Rule 86 of the Missouri Rules of Civil Procedure. The purpose of the City of Bolivar's intended acquisition of the real estate is to convert the real estate into a public park space. Pursuant to 523.250 of the Missouri Revised Statutes, please be advised that you have the right to: a. Seek legal counsel at your expense; b. Make a counteroffer and engage with the City in further negotiations; c. Obtain your own appraisal of just compensation; d. Have just compensation determined preliminarily by court-appointed condemnation commissioners and ultimately, by a jury; e. Seek assistance from the office of the ombudsman for property rights created under 523.277 of the Missouri Revised Statutes; f. Contest the right to condemn in the condemnation proceeding; and g. Exercise the rights to request vacation of an easement under the procedures and circumstances provided for in 527.188 of the Missouri Revised Statutes.
